Amicable settlement of disputes in the public sector

On January 14th, 2020 Mr. Janusz Gwiazdowski - the Coordinator for Negotiations to the President of ERO and Mrs. Monika Stachura managing the Coordinator’s Staff at the Energy Regulatory Office attended a conference held in French-Polish Chamber of Commerce and conducted by International Mediation Center, entitled “Economic mediation with the public sector”.

The event was under the auspice of the President of the General Counsel to the Republic of Poland who personally participated in it.

Conference attendees agreed that albeit the possibility of mediation in the public sector has been around for some time, there are still no spectacular results in this market.

Amendments introduced to Polish legislation in 2016-2017 regarding out-of-court dispute resolution were positively evaluated.

It was pointed out that not only settling the dispute, but also failing to conclude settlement more favorable than a court’s judgment, can and should entail public finance discipline liability.
